| DRUŠTVO ZA UREDITEV ZAMOLČANIH GROBOV Ob Ljubljanici 42 1000 Ljubljana Slovenija Številka:63/2001 Datum: 15.10.2001 OKROZNO SODIŠČE V LJUBLJANI Tavčarjeva 9 1000 Ljubljana ZADEVA: Tožba zaradi prikrivanja zločinov, kraja zločinov in zločincev, ter genocida nad slovenskim narodom, ki ne zastara Tožeča stranka: Društvo za ureditev zamolčanih grobov in za civilno iniciativo še živečih sorodnikov žrtev povojnih pobojev, ki vse zastopa predsednik društva Franc Perme. Tožena stranka: RS, Vlada RS zaradi prikrivanja zločinov in zločincev povojnih množičnih pobojev, ti zločini ne zastarajo, ker je bil izvršen genocid nad slovenskim narodom, saj se je poboj izvršil nad drugače mislečimi Slovenci. OBRAZLOŽITEV: Preživeli sorodniki žrtev povojnih pobojev vlagamo preko Društva za ureditev zamolčanih grobov, Ob Ljubljanici 42, Ljubljana, Slovenija - to je društvo Civilne iniciative v Republiki Sloveniji, tožbo proti toženi stranki, to je povojna revolucionarna. oblast na čelu s Komunistično partijo Slovenije in vodilnimi akterji revolucije v imenu proletarskega internacionalizma, ki so bili izšolani v Sovjetski zvezi za genocid nad slovenskim narodom. Obtožujemo akterje, ki so neposredno dajali povelja za izvrševanje posameznih oz. skupinskih pobojev svojih nasprotnikov v času revolucije 1941 - 1945 - 1952 posebno pa kot tožena stranka nastopa tu organizacija, ki je v medvojnem in povojnem času izvrševala genocidne poboje slovenskega naroda, to so pripadniki KP, VOS-a, OZNE in slovenske divizije KNOJ-a, ter takratno politično in oblastveno vodstvo. Zgodovina in politika je že obsodila nacizem in fašizem, ter ustrezno ukrepala in obsodila idejne tvorce in tudi izvrševalce genocidnosti fašizma in nacizma, ni pa sedanja oblast in demokratična Evropa še organizirala procesa za obtožbo ideologije komunizma in njene voditelje in z njimi vse njegove in njihove posledice, množične poboje nedolžnih ljudi v letih 1945 - 1952. To obdobje velja za območje sedanje države Slovenije. Komunizem kot družbeni sistem in oblast, ki je vodila ta sistem v državi Sloveniji in tudi organizirala in bila izvajalka genocidnih pobojev slovenskega naroda brez sodnih procesov oz. dokazane krivde, še naprej neovirano in brez obtožb mednarodne skupnosti dela, živi in umira kot nedolžni celo kot zaslužni državljani, kot da teh pobojev, ki gredo v stotisoče, ni izvajala tudi še živeča populacija Slovencev, ki so bili maliki komunizma. Evropsko mednarodno sodišče kljub večkratnim opozorilom še ni pristopilo, da organizira sodne procese proti obdobju in vladavini, ki je terjala več milijonske žrtve v Evropi. Obsoja samo fašizem in nacizem ni pa bil še obsojen sistem komunizma, ki ni bil v bistvu različen od prvih dveh, samo da je bil najhujši po posledicah, po njihovih žrtvah. V državi Sloveniji je izšlo že dovolj zgodovinske literature, ki analitično in sumarno prikazujejo žrtve individualnih medvojnih pobojev organiziranih sil komunistične partije, kakor ne masovnih pobojev že po končani II. svet. vojni. Med Slovenci je teh žrtev preko 30.000, ki so pobiti v masovnih pobojih v maju 1945 in sicer v Kočevskem Rogu cca. 8.000, v Teharjih pri Celju cca. 3.000, v rudnikih Laško - Barbarin rov cca. 3.000, v Pancer grabnih pri Brežicah in Mariboru - Tezno cca. 10.000, najnovejša odkritja pa so v zakloniščih tovarne v Slovenski Bistrici, kjer so v zakloniščnem rovu do sedaj izkopali 200 žrtev, da ne govorimo o žrtvah taborišča Šterntal, današnji kraj in tovarna aluminija Kidričevo. Nezaslišano je, kako se slovenske pravosodne oblasti ignorantsko obnašajo do teh dogodkov in do spoštovanja zakonitosti v času povojnih pobojev in sojenj in da ne podpirajo najosnovnejše človekove pravice - pravice do sodbe, imena in groba. Smatramo, da bi sodna oblast bila dolžna že po etiki stroke te izvrševalce iskati in jih privesti pred sodišča. Sprašujemo se, ali se bodo slovenske izvršilne in sodne oblasti sploh potrudile raziskati poboje in odkriti ter obsoditi krivce, zato sprožamo tožbo proti izvrševalcem teh pobojev pri Okrožnem sodišču v Ljubljani RS, saj presegajo žrtve na slovenskih tleh preko 300.000 žrtev različni,h narodnosti.Tožimo tudi sedanjo oblast, ker ne ukrepa kakor bi bilo pričakovati od demokratično izvoljenih predstavnikov ljudstva. Po našem mnenju je temu vzrok povezanost današnjih oblasti z akterji iz časov totalitarnega režima. Ker smatramo, da komunistični totalitarni režim in teror, ki je bil prisoten na naših tleh, še ni dobil sodnega epiloga v Sloveniji, prosimo sodišče, da vzame na znanje dejstva in dokaze in obsodi sistem in njihove soudeležence pri individualnih in masovnih pobojih v državi Sloveniji. Upamo, da bo to zmoglo okrožno sodišče v Ljubljani, kajti Slovenija je edina država v Evropi, ki ni nikoli razčistila s svojo totalitaristično preteklostjo in ni obsodila izvrševalce pobojev. Po našem mnenju so to umori nad ljudmi, ki niso bili sodno obtoženi in zato so po našem mnenju vsi še živeči akterji krivi za zločine, ki so jih zagrešili in mora vse to doživeti sodni epilog in obtožbo. Smatramo da tudi vse žrtve in vojne na Balkanu do leta 2001 izhajajo zaradi tega, ker nobena sodna institucija; niti združena Evropa ni razčistila in obsodila totalitaristični komunistični sistem in njihove pomagače v bivši Jugoslaviji. Dokler Evropa ne bo spoznala, da je to njena dolžnost, toliko časa na prostoru Balkana in bivše Jugoslavije ne bo miru. Zločin proti človeku in človeštvu ne sme nikdar zastarati, niti posthumno ne. To je temeljna vrednota humanega človeštva, in združena Evropa brez obsodbe zločinov in zločincev tudi v primeru slovenskega naroda ne bo pomirjena. Z aktom obsodbe zločina, bi se tudi v Sloveniji dokončal proces narodne sprave in s tem bo odprta pot tudi slovenskemu narodu v združeno Evropo. Nedolžne žrtve genocida slovenskega naroda pa morajo biti sodno rehabilitirane, da se jim vrne dostojanstvo in imetje. We are putting the indictment with the help of the Society for Disposition of Secret Graveyards, Ob Ljubljanici 42, 1000 Ljubljana, Slovenia, which is the association of a civil initiative. V`de are accusing the leaders, who ordered individual or collective executions of their opponents in the time of revolution 1941-1945-1952. Especially in the indictment as a accused party is mentioned the organisation, which committed the executions of slovene nation during the war and after the war, such as KP, VOS, OZNA, and slovene division of KNOJ, and by than time political authority (power). The history and politics had already accused the Nazism and Fascism and correspondingly took steps and indicted the ideological leaders as well as the leaders of Fascism and Nazism, but the democratic Europe, as it is, has not organised yet the indictment or a legislative process (trial procedure) against the Communism and its leaders and its consequences in the form of collective executions of civil population from 1945 till 1952. This period of world history is relevant also for the Republic of Slovenia. Communismas a social system and its ideological leaders as well as the executioners in the Republic of Slovenia, have never been put in the trial process (legislative procedure) and have never been evidenced (proved) as quilt, are at the time being still living in Slovenia as all other slovene inhabitants, like all mentioned horror events and secret graveyards never existed. European International Tribunal despite several warnings still has not organised the trials against the mentioned period and authority (power), which left behind several million of victims in Europe. since it indicted the Fascism and Nazism, we are convinced that also the Communism has to be accused and brought to Court as all its leaders. In the Republic of Slovenia many historical literature has been published on this topic, which analytically presents the victims of individual executions of League of Communists as well as the mass executions, performed after the end of the war. Among slovene inhabitants there are over 30.000 of victims (May 1945 in "Koèevski Rog" approximately 8,000, "Teharje" app.3,000, mines "Laško-Barbarin mine app. 3,000, in "Pamcer. grabnih pri Brežicah and in Maribor - Tezno app. 10,000, and the latest discoveries are in town Slovenska Bistrica app.200, still not mentioning the victims in the concentration camp of Šterntal, at the time being the factory of aluminium Kidrièevo). It is unbelievable in which ignorant manner the slovene judicial authority (legislative power) treats these events as well as it does not stand for the basic human right of judicial process (trail procedure) and appropriate public graveyard. We think, that the judicial authority (legislative power) is obliged according to ethics of the Law and its profession to indict mentioned leaders and bring them to the court. We ask ourselves if slovene legislative authorities (power) would ever make an effort to investigate mentioned mass executions and discover persons, responsible for them, and because of this doubt we are putting in the indictment against those men at the International Criminal Tribunal for the former Yugoslavia since the number of victims of all nations in the territory of Slovenia exceeds the 300,000. We accuse also the present authority since it has not taken any steps regarding this matter. We are convinced that this is so, because the present authority is connected with persons (leaders) responsible for mass executions. Since the League of Communists and its horror in the territory of the Republic of Slovenia, has not been accused yet, we are begging the Court to make itself acquainted with mentioned facts and to accuse the system and its main executioners. We hope that your Court will be able to bring the justice and satisfaction to our wounds, which have been kept secret for over fifty years. The Republic of Slovenia is the only country in the Europe, which has never faced with its past and accused the executioners. Victims have been the civil population, who have never been accused or brought to court, so they should not been executed. We are convinced that all the victims in the territory of Balkan till the year of 2001 derive from the fact, that no institution has never accused the League of eommunists and its actors, leaders in the former Yugoslavia. All the countries, constituting the former Yugoslavia, will be peaceful not later than Europe accuses the League of Communists and its leaders for their past horror. We invite you to start the legislative procedure (trial process) and we also invite you to visit us and see all the facts, which will (we are sure) convince you about mentioned events. The crime against the human being shall never lose the validity. This is the basic value of human beings and United Europe would never be peaceful without accusation of these executors. Indictment would end the process of national conciliation in the Republic of Slovenia and it would open the way of the Republic of Slovenia to join the United Europe. Innocent victims of mentioned genocide should be rehabilitated in a way to bring them dignity and property.
